Resumo
Este trabalho apresenta uma análise da função social de prestação de serviços
educacionais na relação entre o aluno e as instituições pública e privada de
Ensino Superior no sentido da Educação possuir natureza jurídica de direito
humano, fundamental, social e coletivo. Pretende-se demonstrar que, mesmo
quando a Educação Superior é prestada por instituição privada de ensino, há
forte influência do Estado na relação contratual. Apresenta-se, desta forma,
uma reflexão sobre o fato das normas constitucionais se irradiarem nas
relações consideradas de cunho absolutamente privado, como exortação de
valores fundamentais em detrimento dos interesses particulares, o que
prestigia a parte mais fraca da relação para promover um equilíbrio, no
exercício da eficácia horizontal de direitos fundamentais. Objetiva-se, portanto,
contribuir para a compreensão do papel das cotas como forma de acesso à
Educação de grupos desprestigiados historicamente, bem como refletir sobre a
Educação como ferramenta da igualdade. Por fim, analisa-se o PROUNI como
política pública de acesso à Educação Superior e o comportamento do Estado
ao aplicar recursos públicos na iniciativa privada como forma de fomento à
privatização do Sistema Educacional Superior.
Abstract
This paper presents an analysis of the social role of providing educational
services in the relationship between the student and the public and private
institutions of higher education in the sense of Education having a legal nature
of human rights, fundamental, social and collective. It is intended to show that
even when Higher Education is provided by private educational institution, there
is a strong State influence in the contractual relationship. It is presented, in this
way, a reflection on the fact that the constitutional requirements radiate in
relations that are considered absolutely private nature, as exhortation of core
values at the expense of private interests, which honors the weakest part of the
relationship to promote a balance, in the exercise of horizontal effect of
fundamental rights. The intention is, therefore, to contribute with the
understanding of the role of quotas as a path of access to education of
historically underprivileged groups and reflect on education and equality tool.
Finally, PROUNI is analyzed as a public policy of access to Higher Education
and the State's behavior in applying public resources in the private sector as a
way of promoting the privatization of Superior Educational System.
