Resumo
A presente dissertação foi desenvolvida através de pesquisa para cumprir uma das exigências do Curso de Pós-Graduação stricto sensu (Mestrado) da Universidade Metodista de Piracicaba (UNIMEP), Núcleo de Estudos de Direitos Fundamentais e da Cidadania – NEDFC.
Tal pesquisa direciona-se correlativamente à área de Direito de Família, assunto não excludente entre si e intimamente relacionado ao Direito Constitucional e à Proteção dos Direitos Fundamentais na contemporaneidade com orientação do Professor José Luiz Gavião de Almeida.
Não há ramo do Direito Privado em que a dignidade da pessoa humana tenha mais ingerência ou atuação do que o Direito de Família. Numa análise, sobretudo sob a perspectiva da hermenêutica, com uso de ferramentas bibliográfica e documental, esta, apesar de seu caráter teórico, mas com real função prática, no prisma de uma perspectiva constitucional e sob a ótica do atual Código Civil, deve-se reconhecer a proteção especial dada constitucionalmente à família e suas várias transformações ao longo de seu histórico, à luz dos Direitos Fundamentais. Para que nesse sentido estabeleça-se os parâmetros que venham a reconhecer a família nos seus mais novos e diferenciados modelos, como objetivo principal desta dissertação.
Abstract
This work was developed through research to fulfill one of the requirements of the strict sense Postgraduate degree (Masters) of the Methodist University of Piracicaba (UNIMEP) Study Group on Fundamental Rights and Citizenship - NEDFC.
Such research is correspondingly directs the family law area, not subject excluding each other and closely related to constitutional law and the protection of fundamental rights in contemporary times with supervision of Professor José Luiz de Almeida Hawk.
There is no branch of private law in which the dignity of the human person has more interference or performance of the Family Law. In an analysis, especially from the perspective of hermeneutics, using bibliographic and documentary tools, this in spite of its theoretical character, but with real practical function, the prism of a constitutional perspective and from the perspective of the current Civil Code, it should be recognize the special protection given constitutionally the family and its various transformations throughout its history, in the light of fundamental rights. For this direction is established, the parameters that will recognize the family in his younger and different models, the main objective of this thesis.
