Resumo
A presente dissertação tem como objetivo a análise da prestação da assistência consular a nacionais em território estrangeiro tal qual previsto na Convenção de Viena sobre Relações Consulares de 1963. Para tanto, serão analisados diversos instrumentos jurídicos de variados países que incorporam os dispositivos da Convenção. Sendo assim, o trabalho apresentado inicia-se com o histórico de elaboração da Convenção de Viena, apresentando os comentários tecidos pelas nações presentes à época e a atual situação da Convenção. Em seguida será analisado como é prestada a assistência aos nacionais. No último capítulo será dado foco na assistência para nacionais acusados de crimes e sua situação jurídica. Por fim, o trabalho será concluído tratando do desenvolvimento trazido pela Convenção de Viena e, em especial, das mudanças decorrentes dos litígios previstos no artigo 36 da Convenção.
Abstract
This thesis aims to analyze the provision of consular assistance to nationals in foreign territory as established by the Vienna Convention on Consular Relations of 1963. It will analyze various legal instruments of different countries. Therefore, the works starts by presenting the drafting history of the Vienna Convention, presenting the comments made by these nations and the present Convention of the situation of the Convention. Then it will analyze how the assistance to nationals is carried out. In the last chapter, it will focus on assistance to the national accused of crimes and their legal status. Finally, the conclusion of the work will be presented, dealing with the development brought by the Vienna Convention and in particular of the changes resulting from litigation brought by Article 36 of the Convention.
