Resumo
O trabalho tem a finalidade de demonstrar de que modo a esfera pública contribuí no processo democrático de legitimação do direito. Como problemática central temos ( seguinte questão: o direito guarda relações com a política? O trabalho jgualmente se preza para demonstrar a importância de uma esfera pública autônoma face aos sistemas político e econômico, já que a independência deste espaço é importante nas democracias. Daí a importância da atuação da sociedade civil nesta esfera, tendo em vista que é justamente nela que as opiniões e as vontades se formam livremente; também é nela que os atores organizados da sociedade civil questionam a atuação da autoridade política reinante. Também é o espaço de reivindicações, de debates, de problematizações e de tematizações. Enfim, trata-se de um espaço pré-parlamentar que deve ser preservado e assegurado por um Estado Democrático de Direito muito bem aparelhado juridicamente no sentido de garantir a cada cidadão os direitos de participação, bem como os direitos subjetivos ou individuais. Com efeito, a voz dos atores articulados numa esfera pública participativa, garantida e protegida juridicamente deve ressoar livremente na esfera política parlamentar, sob pena de termos um direito ilegítimo e distante dos anseios e das reais necessidades da sociedade civil. Em poucas linhas, é a respeito destas questões as quais visamos discorrer; numa perspectiva crítica, nossas indagações sempre partem das análises engenhosamente construídas por Jurgen Habermas, filósofo do direito e da política que se preocupa com as condições processuais da gênese democrática das leis, condições que asseguram a legitimidade do direito.
Abstract
The work has the purpose to demonstrate of that way the public sphere contributes in the construction of a legitimate right. This implies in a demonstration of that the right a strict bond with the politics. The work equally if to demonstrate to the importance of a public sphere independent face to the systems economic politician and, since the independence of this space is to very important in the democracies. From there the importance of the performance of the civil society in this sphere, in view of that it is exactly in that the opinions and the wills if form freely; also he is that the organized actors civil society question the performance of authority politics. Also it is the space of claims. At last, parliamentarian is about a space who must be preserved and be assured by a Democratic State of Right very equipped well in the direction to guarantee to each citizen the participation rights, as well as the subjective or individual rights. With effect, the voice of the actors articulated in a public sphere, guaranteed and protected parliamentary politics must resound freely in the sphere, duly warned terms an illegitimate and distant right of the yearnings and the real necessities of the civil society. In few lines, it is the respect of these questions which we aim at to discourse; in a critical perspective, our investigations always leave of the analyses ingeniously constructed by Jürgen Habermas, philosopher of the right and the politics who if worries about the procedural conditions of democratic of the laws, conditions rank that assure the legitimacy of the right.
