Resumo
Esta pesquisa se propôs a estudar as mudanças no sistema bancário brasileiro numa visão sócio-jurídica, analisando a precarização das relações de trabalho. Enfoca o processo de globalização financeira, a reestruturação produtiva no sistema bancário, o avanço tecnológico e a velocidade da informação, considerando a importância e a transversalidade do sistema bancário na economia, as influências neoliberais, as fusões, as privatizações, a internacionalização das instituições financeiras no Brasil, o lucro dos bancos e sua força perante o Estado. Também são abordadas as terceirizações no setor bancário, a redução do emprego, o enfraquecimento sindical, a legislação trabalhista bancária e suas normas coletivas. São apresentadas as formas de remuneração bancária, com análise crítica da remuneração variável, avaliando-se que esta forma de contraprestação está atrelada ao enfraquecimento dos laços sociais e ao aumento do assédio moral no ambiente de trabalho. A conseqüência dos fenômenos mundiais e nacionais elencados na dissertação, a partir da década de 1990, é a intensificação do trabalho, com os novos métodos de dominação pelo capital, sistematizados em programas de treinamento, qualidade total e remuneração variável. O nível de excelência cobrado na prestação do serviço; a pressão por produtividade, resultados e cumprimento de metas e a ameaça do desemprego distanciaram o bancário da luta sindical e o sujeitaram às imposições do capital e, por conseqüência, geraram a precarização dos seus direitos trabalhistas.
Abstract
This work proposes to evaluate the changes in the Brazilian banking system through a socio-legal view, considering the precariousness of labor relations. It focuses on the process of financial globalization, productive restructuring of the banking system, technological progress and speed of information, considering the importance of the banking system and across the economy, the neoliberal influences, mergers, privatization, internationalization of financial institutions in Brazil, the profit of the banks and their strength to the state. It also demonstrates the outsourcing in the banking sector, the reduction of jobs, weakening the union, the labor legislation and banking rules collectively. The paper presents the forms of payment adopted by the banks, with critical analysis of the implementation of a variable remuneration system for its personnel, this form of payment is considered as the cause of the weakening of social ties in the workplace. The consequence of the global and national happenings of the 1990s is the intensification of work, with new methods of domination by capital, organized in training programs, total quality and variable remuneration. The level of excellence in service, the pressure for productivity, the performance and target actions for results and the threat of unemployment, made the bank employees away from the union fight and subjected them to capital interests and, consequently, caused the precariousness of their labor rights.
