Resumo
A concessão da anistia pela Lei n. 6.683 de 28 de agosto de 1979 para os agentes estatais que realizaram a repressão política do regime militar é bastante contestada pelas vítimas da repressão, pela população em geral e por certos autores. Desse modo, nossa pesquisa pretende tratar sobre os problemas de validade da Lei de anistia brasileira, indagando se essa lei pertence ao ordenamento jurídico ou não. Ou seja, se ela é juridicamente válida ou inválida. Após termos analisado a criminalidade estatal objeto da anistia, a problemática da justiça de transição a que ela se insere e o entendimento do que seja a anistia nos seus mais diversos aspectos, nós concluímos que a Lei n. 6.683/79 é juridicamente válida, socialmente eficaz, axiologicamente ilegítima ou injusta. Apesar dessa lei contrariar aos vários critérios por nós estabelecidos para que ela possa ser considerada justa, legítima ou moralmente admitida, ela não deixa de ser uma norma juridicamente válida, pertencendo, portanto, ao ordenamento jurídico brasileiro e tendo força vinculante.
Abstract
Amnesty concession by Law n. 6.683 from August, 28th 1979 to all the state agents who executed the politic repression during the military regimen is quite contested by the repression victims, by the general population and by some authors. Our research intends to treat of the problems on the validity of the Brazilian law of amnesty, wondering if this law belongs to the juridical ordinance or not. What means, if it is juridically valid or not. After analyzing the state criminality amnesty object, the problematic of justice transition where it fits in and the understanding of what amnesty means on its most several aspects, we concluded that the Law n. 6.683/79 is juridically valid, socially effective, axiologically illegitimate or unfair. Despite this law opposes to several criteria established by us so that it can be considered fair, legitimate or morally accepted, it doesn’t stop being a juridically valid ruled, belonging, then, to the Brazilian juridic ordering and having active force.
