Resumo
Por objetivo principal, elevando-se a dignidade da pessoa humana, o presente trabalho trata
da inclusão do direito à origem genética pelo filho adotivo entre os direitos fundamentais,
amparados pela Constituição Federal de 1988. Para isso, alguns caminhos foram trilhados
para servirem de indicativo e reforçarem a assertiva. É cediço que o direito de acessar a
origem genética pelo filho adotivo entrou no nosso sistema por imposição legal decorrente
da cidadania como mecanismo ampliador de direitos e decorrência do direito de filiação.
Muito lentamente envolvem-se os temas familiares com os direitos coletivos e difusos, legitimando o Ministério Público para atuar em juízo em nome dos direitos dirigidos às famílias. As preocupações com os empecilhos levantados pela bioética devem conduzir o legislador à elaboração de normas legais que afastem a impossibilidade de se exercitar o direito à origem genética, como no caso de emprego das técnicas de reprodução artificial para alterar o núcleo da célula germinativa e modificar as características do ser humano a
ser gerado.
Abstract
On the main objective, rising to the dignity of the human person, this paper deals with the addition of the right to genetic origin for the adopted son of the fundamental rights, protected by the Federal Constitution brazilian1988. Thus, some paths have been trodden to serve as a target and strengthen the assertion. It's musty that the right of access to genetic origin for the child entered foster in our system of legal enforcement mechanism as a result of citizenship rights and magnifier due to the right of membership. Very slowly engage the familiar themes with the collective and diffuse rights, legitimizing the Prosecutor to act in court on behalf of rights aimed at families. Concerns about the obstacles raised by bioethics must lead the legislature to draw up laws that differ from the impossibility of exercising the right to genetic origin, as in the case of employment of artificial reproduction techniques to change the core of germ cell and modify the characteristics of the human to be generated.
