EDUCAÇÃO ESCOLAR, ESTADO E MUNICÍPIO: ANÁLISE DA DESCENTRALIZAÇÃO DE ENSINO NO ESTADO DO RIO DE JANEIRO DURANTE A VIGÊNCIA DO FUNDEF (1998 - 2006)

Resumo
Esta pesquisa investiga a desconcentração e a descentralização da educação escolar no Estado do Rio de Janeiro, pela via da municipalização, durante a vigência da Emenda Constitucional nº 14/1996, que criou o Fundo de Manutenção e Desenvolvimento do Ensino Fundamental e Valorização do Magistério – FUNDEF (1998 – 2006), e da Lei nº 9.424, de 24 de dezembro de 1996, que o regulamentou. Procede-se à análise do objeto de estudo, a partir do entendimento de que a oferta da educação escolar configura um corpo que é atravessado por três eixos, em torno dos quais pode executar movimentos, simultâneos ou não, entendendo-se como eixos: desconcentração/descentralização/municipalização; financiamento/FUNDEF; e governança no Sistema Público de Ensino do Estado do Rio de Janeiro. O estudo privilegia as referências bibliográficas, as fontes documentais e as entrevistas na análise. A abordagem se desenvolve com base na perspectiva histórica, legislativa e teórica com o propósito de situar e entender o movimento descentralizador da educação. Realiza-se a revisão de literatura sobre as teorizações acerca do continuum centralização – desconcentração – descentralização e a sua materialização na educação escolar mediante os aspectos do regime federativo. Busca-se compreender a dinâmica da educação escolar sob os prismas do Ato Adicional de 1834, das Propostas de Reformas Educacionais e das Leis de Diretrizes e Bases da Educação Nacional, enquanto dispositivos fundamentais à análise dos cenários que vieram a forjar o movimento descentralizador no Brasil. Apresentam-se os aspectos singulares da história e administração do Estado do Rio de Janeiro, antes e depois da fusão. Aborda-se a educação escolar que se configura no Estado do Rio de Janeiro a partir dos Programas de Municipalização no âmbito da Secretaria de Estado de Educação e, também, na vigência do FUNDEF. Faz-se um sucinto esboço da legislação federal pertinente ao financiamento da educação e ao regime de colaboração. Por fim, apresenta-se o quadro que caracteriza o atendimento à demanda por nível de ensino e por instância administrativa na rede pública em função das medidas desconcentradoras/descentralizadoras ocorridas. A pesquisa aponta a presença do ensino municipal há muito tempo no Estado do Rio de Janeiro; mais recentemente, a indução à municipalização pelo PROMURJ, pelo FUNDEF e pelo FUNDEB; considera ainda que, neste sistema de Fundos, as escolas municipalizadas tenderão a continuar sob esta dependência administrativa, além das iniciativas de ampliação em atendimento às demandas demográficas.
Abstract
This research investigates the devolution and decentralization of school education in the State of Rio de Janeiro, through the municipality, during the term of the Constitutional Amendment n°.14/1996, which created the Fund for the Maintenance and Development of Fundamental Education and Valorization of Teaching - FUNDEF (1998 - 2006) and Law n°. 9424 of December 24, 1996, which regulated FUNDEF. The research proceeds to the analysis of the object of study, based on the understanding that the provision of school education set up a body that is crossed by three axes around which movement can perform simultaneous, or not, it being understood as axes: devolution / devolution / decentralization; financing / FUNDEF, and governance in the Public School System of the State of Rio de Janeiro. The study highlights the references, documentary sources and interviews in the analysis. The approach is developed based on the historical perspective, legislative and theoretical in order to situate and understand the movement of decentralizing education. The research carries out a review of the literature on continuum theories about the centralization - decentralization - decentralization and its materialization in the education aspects of the school through the federal system. It seeks to understand the dynamics of school education under the prism of the Additional Act of 1834, the Educational Reform Proposals and the Laws of Guidelines and Bases of National Education as key devices for the analysis of the scenarios that came to forge a decentralizing movement in Brazil. It is presented the unique aspects of the history and administration of the State of Rio de Janeiro, before and after the merger. It approaches to schooling that is configured in the State of Rio de Janeiro from municipalization programs within the State Department of Education and also in the presence of FUNDEF. It is a brief outline of federal legislation pertaining to education funding and collaboration system. Finally, it is presented the framework that characterizes the meet demand by education level and administrative level in the public according to the measures deconcentrated / decentralization occurred. The study suggests the presence of the local school for a long time in the State of Rio de Janeiro, more recently, induction by the municipalization due PROMURJ, FUNDEF and FUNDEB; also believes that this system of funds, the municipal schools tend to remain under this administrative dependency, in addition to initiatives to expand in response to demographic demands.
