Resumo
Trata-se de pesquisa bibliográfica que, tomando como referencial a Teoria dos Direitos Fundamentais de Robert Alexy, visa demonstrar que o princípio da dignidade da pessoa humana atua como fundamento aos chamados direitos fundamentais sociais. Para demonstrar a correção do argumento, serão analisados os conceitos de dignidade, a partir da sua matriz filosófica e sua concepção jurídica; de direitos fundamentais, em sua relação com temas como direitos humanos e direitos do homem; e de direitos sociais, bem como questões relacionadas à teoria do mínimo existencial e à eficácia das normas constitucionais e de direitos sociais. Por fim, buscar-se-á demonstrar a importância do presente estudo por meio da apresentação de alguns exemplos que ratificam o déficit de concretização dos direitos sociais, ilustrando-se também como as teses discutidas nessa pesquisa são alvo constante de apreciação pelo Supremo Tribunal Federal. A dissertação encerrar-se-á apresentando considerações acerca da contribuição teórica de Robert Alexy para a compreensão dos direitos fundamentais sociais em sua relação com o princípio da dignidade da pessoa humana no texto constitucional brasileiro.
Abstract
This is a literature research aiming to demonstrate, using as a reference the Theory of Fundamental Rights of Robert Alexy, that the principle of human dignity underlies the so called fundamental social rights. Intending to prove by reasoning the correctness of the argument, the essay will investigate the concepts of dignity from its philosophical roots and its legal conception; of fundamental rights in regard to related subjects such as human rights and rights of the man; and of social rights, as well as the issues about existential minimum and the effectiveness of constitutional law and social rights. Finally, it will seek to demonstrate the importance of the matter by presenting some examples that confirm the actuality of social rights deficit, also remarking that the topics of this research are often referred to by the Supreme Court. The dissertation will then be finished with considerations on Robert Alexy’s contribution to the understanding of fundamental social rights in their relation to the principle of human dignity in the Brazilian Constitution.
