Resumo
Os Direitos fundamentais, também em sua faceta coletiva e difusa, tiveram um processo de formação próprio, pautado no desenvolver histórico, em momentos que afloraram na sociedade o anseio por direitos que já lhe pertenciam, mas não lhe eram realizados. Conclamadas as liberdades públicas, seguiram-lhes os direitos sociais, culturais e econômicos, bem como os de solidariedade, fraternidade, direito a paz e outros supranacionais, direitos da comunidade humana. Tais direitos, hoje, continuam a enfrentar as barreiras da realidade, e a realização dos direitos humanos fundamentais carecem de efetividade real. As políticas públicas surgidas da Ciência Política e - de de outras disciplinas emergiram no anseio e na necessidade de tornar efetivos direitos que há muito estão distantes da igualdade material, no seu sentido real. Reconhecer a necessidade de diálogo na Ciência do Direito relativo às políticas públicas e, motivar a ciência jurídica a promover uma resposta para a legitimação da efetividade dos direitos fundamentais são os princípios norteadores do caminho que se busca no sentido de se ver, um dia os direitos humanos fundamentais coletivos e difusos postos a todos, em toda comunidade humana. As políticas públicas não são os únicos instrumentos capazes de colaborar com o desafio de tornar efetivos os direitos fundamentais, mas podem adquirir um papel importante nesse cenário em que, aos poucos, brilham as luzes para a beleza do espetáculo da sociedade humana se realizando.
Abstract
The Fundamental Rights, also in its collective and diffuse facet, had its own process of formation based on a historic development, in which surfaced moments that the society yearned for rights that already belong to it, but were not performed. Once the individual liberty became true, came the social, cultural and economic rights, as well as solidarity, fraternity, peace and other rights supranational, community human rights. Such rights today continue to face barriers and the realization of fundamental human rights require real effectiveness. Public policies arising from Political Science and interdisciplinary emerged in a need to enforce rights that have been distant from the material equality, in its real sense. Recognize the need of dialogue in the Laws of Science regarding public policies and motivate the Science in order to promote a legal response to the legitimating of the effectiveness of fundamental rights is the guiding path that is sought in order to see one day the fundamental human rights collective and diffuse to all posts in the entire human community. Public policies are not the only instruments capable of collaborating with the challenge of making effective fundamental rights, but can acquire an important role in this scenario that gradually lights the beauty of the spectacle of human society that happens.
