Resumo
O objetivo deste trabalho foi realizar um cotejo entre as Convenções Islâmicas de Direitos Humanos e os direitos fundamentais que norteiam a vida das mulheres muçulmanas à luz dos sistemas internacional e regionais de proteção dos direitos humanos. Para tanto, discutiu-se a compatibilidade entre os princípios do Estado religioso e/ou também denominado teocrático e o exercício dos direitos fundamentais. Aliada a essa discussão, pesquisou-se a condição feminina nas sociedades islâmicas nas perspectivas política, histórica e cultural, tendo em vista a aplicação das leis corânicas, como também o seu impacto no tocante à tutela dos direitos fundamentais das mulheres muçulmanas. No decorrer do estudo analisou-se a laicidade enquanto condição indispensável para a tutela dos direitos fundamentais. Discutiu-se ainda a existência ou não de um sistema de proteção regional islâmico de direitos humanos, a compatibilidade das CISDH com os sistemas internacional e regionais de direitos humanos e o desafio de cunhar um direito humano universal mesmo que de ordem mínima, qual seja, direito à vida e integridade física de todo e qualquer ser humano, numa perspectiva multicultural.
Abstract
The aim of this study was a comparison between the Islamic Human Rights Conventions and fundamental rights that guide the lives of Muslim women in the light of international and regional systems of human rights protection. Thus, we discussed the compatibility between the principles of the religious State and / or also called, theocratic State and the exercise of fundamental rights. Allied to this discussion, the status of women in Islamic societies was researched and studied the political, historical and cultural prospects, in view of the application of the laws of the Quran, as well as its impact in relation to the protection of fundamental rights of Muslim women. During the study, it was analyzed the laity as the indispensable condition for the protection of fundamental rights. It was also discussed, the existence or no of an Islamic system of regional protection of human rights, the compatibility of the Islamic Conventions about Human Rights with the international and regional systems of human rights and the challenge to coin an universal human right even the minimum order, namely, the right to life and physical integrity of each and every human being, in a multicultural perspective.
