Resumo
Esta pesquisa teve como objeto de estudo os Conselhos Municipais de Educação (CME) de catorze municípios do polo 17 da União Nacional dos Conselhos Municipais de Educação do Estado de São Paulo (UNCMESP) ancorando-se teoricamente em conceitos de democracia representativa, Estado e sociedade civil. Os CME, órgãos que fazem parte do processo de
descentralização e democratização nacional, como espaços colegiados que possibilitam a participação da sociedade civil na gestão educacional do município. Objetivou-se com esta pesquisa verificar se cada município instituiu o Sistema Municipal de Ensino (SME); se cada Conselho é ou não um elemento constitutivo deste sistema; se o município apresenta o
Plano Municipal de Educação (PME). Trata-se de uma pesquisa descritiva, de apreensão e análise do objeto, que compreende, metodologicamente, duas etapas: a revisão bibliográfica e a pesquisa documental. Os documentos legais analisados são com âmbito nacional, estadual e municipal. Com cada município pesquisado analisamos a lei Municipal que criou o Sistema Municipal de Educação; a lei Municipal que criou o Conselho Municipal de Educação (CME); o Regimento Interno do CME e o Plano Municipal de Educação (PME). As discussões teóricas foram realizadas a partir da leitura de obras de diferentes autores como
Weber, Bobbio, Torres, Schwartzman, Cury, Oliveira, Bordignon, Monlevade entre outros tantos autores.Focamos o funcionamento do CME a partir de aspectos jurídico-legais e político-administrativos, apresentando o cenário e os processos que regulam os conselhos.
Os resultados obtidos com a análise das leis municipais mostraram a fragmentação e pouca participação da sociedade civil nos CME e na elaboração do PME. Ainda é muito incipiente a atuação dos CMEs com função propositiva e mobilizadora da população nas decisões no
município. O poder público municipal tem demonstrado desconhecer o verdadeiro papel dos CME e não os usufruem como órgãos auxiliadores na proposição e no acompanhamento de políticas educacionais do município.
Abstract
This research had as object of study the Municipal Councils of Education (CME) of fourteen
municipalities in the polo 17 of the National Union of Municipal Education Councils of the
State of São Paulo (UNCMESP) anchoring itself theoretically in concepts of representative
democracy, State and civil society. The CME, organs that are part of the process of national
decentralization, and democratization, as collegiate spaces that allow the participation of civil
society in educational management of the municipality. The aim with this research was to
verify if each municipality established the Municipal Education System (SME); if each board
is or not a constitutive element of this system; if the municipality presents the Municipal Plan
of Education (PME). It is a descriptive research, of apprehension and analysis of object,
comprising, methodologically, two steps: a literature review and documentary research. The
legal documents analysed belong to national, state and municipal levels. With each
municipality researched we look at the Municipal law that created the Municipal Education
System; the Municipal law that created the Municipal Council of Education (CME); the
internal regulations of the CME and the Municipal Plan of Education (PME). The theoretical
discussions were held from the reading of works by different authors such as Weber, Bobbio,
Torres, Schwartzman, Cury, Oliveira, Bordignon, Monlevade among many others authors.
We focus on the functioning of the CME from legal and administrative policy aspects,
presenting the scenario and the processes governing the boards. The results obtained from
the analysis of municipal laws showed the fragmentation and lack of participation of civil
society in the CME and in the drafting of the PME. It's still very incipient the activity of CMEs
with purposeful function and mobilizing of the population in decisions in the municipality. The
municipal government has shown disregard the true role of CME and don’t enjoy them as
helpers organs in the proposition and monitoring of educational policies of the municipality.
