Resumo
Este trabalho, fundamentado no realismo jurídico, foi elaborado com fundamento metodológico em pesquisa bibliográfica, sustentado numa visão dogmática, aborda a responsabilidade civil pela exposição não autorizada de imagens na rede social “Facebook”, verificando aspectos da rede mundial de computadores, estrutura das redes sociais, o modo de funcionar da rede “Facebook”, o Direito fundamental de proteção da Imagem e efetivamente a discussão da responsabilidade civil em questão; o trabalho, igualmente, sugere inovações ao Marco Civil da Internet, como medida que visa melhorar a proteção jurídica da imagem no mundo virtual.
Abstract
This paper was prepared with methodological basis in bibliographical research, sustained in a dogmatic vision deals with civil liability for unauthorized display of images on the social networking site "Facebook", checking aspects of the World Wide Web, the structure of social networks, the work of the network "Facebook", the fundamental right of protection of the image and effectively the discussion of liability in question; the work also suggests innovations of the internet civil law, as a measure to improve the legal protection of the image in the virtual world.
