Resumo
Esta dissertação tem o objetivo de abordar as questões a respeito das Teorias
da Decisão Judicial, que é um dos temas mais estudados em Direito na
contemporaneidade. Por estarmos inseridos em um Estado Democrático de
Direito que se impõe com uma série de compromissos, essa pesquisa trabalha
a temática do ponto de vista do Neoconstitucionalismo, que se instaurou após a
Segunda Guerra Mundial, e também com base no estudo filosófico do Direito.
Portanto, o tema é abordado não apenas com base em um Direito
Constitucional, mas com o foco centrado no problema dos pressupostos que
envolvem toda e qualquer ciência. Assim, a pergunta norteadora dessa
pesquisa é: como criar uma teoria que comungue as respostas às
necessidades sociais por meio de respostas corretas por parte dos juízes. Para
tanto, a Teoria da Reposta Correta, de Lenio Luiz Streck, ganhou especial
atenção, sofrendo, contudo uma crítica por parte da Filosofia da Consciência
no último capítulo deste trabalho.
Abstract
This dissertation aims to address questions about the Theories of Judicial
Decision, which is one of the most studied topics in the contemporary law. By
being inserted into a democratic state that imposes itself with a series of
commitments, this research work the issue from the point of view of
Neoconstitutionalism, which arose after the Second World War, and also based
on the philosophical study of law. Therefore, the subject is approached not only
based on a constitutional law, but with the focus centered on the problem of
assumptions involving any science. Thus, the central question of this research
is: how to create a theory that commune responses to social needs by means of
correct responses by the judges. To do so, the Correct Response Theory of
Lenio Luiz Streck, gained special attention, suffering, yet critical by the
Philosophy of Consciousness in the last chapter of this work.
