Resumo
O presente trabalho tem por escopo o estudo da vulnerabilidade jurídica e social dos trabalhadores migrantes, através da análise das determinações da legislação internacional, constitucional e infraconstitucional. Além disso, busca-se analisar as condições laborais a que estes são submetidos, como a constante violação de direitos trabalhistas e direitos humanos fundamentais. Assim, primeiramente busca-se abordar os direitos sociais fundamentais do imigrante, o processo migratório para o país e a definição vocabular de migrante utilizada neste trabalho. Em seguida, estudam-se os principais instrumentos internacionais de proteção ao trabalhador estrangeiro, tanto da Organização Internacional do Trabalho, quanto da Organização das Nações Unidas e da Corte Interamericana de Direitos Humanos. Após, aborda-se a proteção nacional a este imigrante, tanto na órbita constitucional, quanto infraconstitucional. Por conseguinte e adentrando a esfera social do trabalho, direciona-se a análise ao trabalhador migrante regular e o irregular, bem como suas consequências na esfera social do trabalho, seguido da proibição de discriminação nas relações laborais. Verifica-se ainda, a livre circulação do trabalhador fronteiriço no MERCOSUL e demais países associados e a normas protetivas em vigor. Por último, aborda-se a vulnerabilidade jurídica e social do trabalhador migrante, destacando-se a relevância dos direitos humanos para a edição de uma política migratória, bem como a tutela jurisdicional a esses trabalhadores, finalizando com uma reflexão acerca dos desafios acarretados pelas migrações contemporâneas. Do ponto de vista metodológico adotou-se o método jurídico-sociológico, utilizando-se de fontes imediatas jurídico-formais de pesquisa.
Abstract
This work is to scope the study of legal and social vulnerability of migrant workers, through the analysis of the determinations of international law, constitutional law and infra law. It also seeks to analyze the working conditions to which they are subjected, as the constant violation of labor rights and fundamental human rights. So, first we seek to address the fundamental social rights of immigrants, the migration process for the country and the definition of migrant vocabulary used in this work. Then we study the main international instruments of protection of foreign workers, both the International Labour Organization, as the United Nations and the Inter-American Court of Human Rights. After, it deals with the national protection of this immigrant both in constitutional orbit, as infra. Therefore and into the social sphere of work, directs the analysis to the regular and irregular migrant workers and its consequences in the social sphere of work, followed by the prohibition of discrimination in labor relations. There is also the free movement of frontier workers in MERCOSUR and other associated countries and the protective standards. Finally, it deals with the legal and social vulnerability of migrant workers, highlighting the relevance of human rights to the issue of an migration policy and judicial protection to these workers, ending with a reflection on the challenges posed by contemporary migration. From a methodological point of view we adopted the legal and sociological method, using legal and formal immediate sources of research.
