Resumo
A presente dissertação tem por objetivo demonstrar que a dissonância entre a
evolução das técnicas médicas e a respectiva regulamentação da saúde privada
enseja o ingresso de ações judiciais pelos usuários de planos de saúde, sendo que
a solução ofertada pelos magistrados vem gerando insegurança nos contratos
firmados pelas operadoras de planos de saúde, haja vista o caráter securitário dos
mesmos, fazendo incorrer a coletividade contratante na “socialização” dos prejuízos
advindos com tais medidas judiciais, em nítida judicialização da saúde suplementar
ao transferir o dever constitucional do Estado à saúde universal à iniciativa privada.
Abstract
This dissertation aims to demonstrate the dissonance between the evolution of the
medical techniques and the respective regulation of private health entails the filing of
lawsuits by the users of health care insurance, with the solution given by the judges
generating insecurity in the contracts signed by the health care operators, taking into
account the securitary character of the contracts, making the contracting party
colectivity incurr in the "socialization" of the damages arising from such judicial
measures, with a clear judicialization of the supplementary health by transferring to
the private initiative the State's constitutional duty to provide health universally
