Resumo
A presente dissertação tem o objetivo de analisar o reconhecimento da união estável homoafetiva enquanto família. Para isso, foi realizado estudo multidisciplinar sobre família. Para a pesquisa, utilizou-se o método descritivo-qualitativo, extraídos os dados de obras literárias, artigos de internet e decisões judiciais. Verifica-se, até hoje, a omissão na legislação pátria sobre o assunto, tendo o Supremo Tribunal Federal decidido a questão em 2011. Na referida decisão foram observados os princípios constitucionais, e o método de interpretação utilizado foi o de acordo com a Constituição Federal, indo além da literalidade da norma. Na decisão e na interpretação, o afeto caracterizou-se como fundamento preponderante da família contemporânea. A decisão da Corte garantiu à minoria desfavorecida dos homossexuais um status de entidade familiar, concedendo-lhes direitos e deveres iguais às uniões heterossexuais.
Abstract
The present dissertation has the objective of analyzing the recognition of stable homoaffective union as a family. For this, a multidisciplinary family study was carried out. For the research, we used the descriptive-qualitative method, extracted the data of literary works, articles of internet and judicial decisions. The Brazilian Supreme Court has ruled the matter in 2011. The constitutional principles were observed in that decision, and the interpretation method used was the one according to the Federal Constitution , Going beyond the literalness of the norm. In decision and interpretation, affection was characterized as the preponderant foundation of the contemporary family. The Court's decision guaranteed the disadvantaged minority of homosexuals a status of family entity, granting them equal rights and duties to heterosexual unions.
