Resumo
O presente trabalho traz um estudo histórico da liberdade religiosa desde os antecedentes históricos no direito comparado e no Brasil, tudo sob um viés constitucional; assim, passamos pelo período pré-colonial e colonial, pelo descobrimento do Brasil, as Constituições do Império e das Repúblicas, até estacionarmos na Constituição de 1988. Mais especificamente, o tema foi analisado sob o olhar dos direitos e deveres fundamentais, individuais e coletivos. Definindo o conceito de liberdade e igualdade, adentramos nas vertentes da liberdade em estudo: liberdade de crença, de consciência, pensamento religioso, liberdade de culto e organização religiosa. Abrindo a discussão trouxemos questões controvertidas à respeito da separação entre Estado e Igreja, a Laicidade adotada pelo Estado brasileiro, suas consequências e o tema da a transfusão de sangue nos pacientes seguidores da religião Testemunhas de Jeová, incluindo precedentes judiciais, à respeito deste procedimento em menores de idade, bem como em pessoas que já adquiriram a maioridade civil, gozando plenamente de autonomia de vontade. Assim, enfrentamos a questão da colisão entre os princípios envolventes: a liberdade religiosa e o direito à vida, a fim de se buscar uma solução por meio da técnica da ponderação ou sopesamento de princípios. Desta forma, pretendemos com o presente trabalho, após estudo histórico e das instituições que envolvem a liberdade religiosa, com utilização de ensinamentos doutrinários, legislação e jurisprudência, trazer à tona a importância da preservação desta liberdade, um dos princípios mais importante do nosso Estado Democrático de Direito, e se trata de direito da personalidade do indivíduo, que é essencial ao mesmo e faz parte do seu ser desde o seu nascimento.
Abstract
The present work brings a historical study of religious freedom from the historical antecedents in comparative law and in Brazil, all under a constitutional bias; Thus, we went through the pre-colonial and colonial period, through the discovery of Brazil, the Constitutions of the Empire and the Republics, until we parked in the Constitution of 1988. More specifically, the theme was analyzed under the watch of fundamental, individual and collective rights and duties . Defining the concept of freedom and equality, we enter the strands of freedom under study: freedom of belief, conscience, religious thought, freedom of worship and religious organization. Opening the discussion, we have brought controversial questions about the separation of State and Church, the Laity adopted by the Brazilian State, its consequences and the issue of blood transfusion in Jehovah's Witnesses, including judicial precedents, regarding this procedure in Minors, as well as persons who have already acquired the civilian majority, enjoying full autonomy of will. Thus, we face the question of the collision between the surrounding principles: religious freedom and the right to life, in order to seek a solution through the technique of pondering or weighing principles. In this way, we intend with the present work, after historical study and of the institutions that involve religious freedom, using doctrinal teachings, legislation and jurisprudence, to bring to the fore the importance of the preservation of this freedom, one of the most important principles of our Democratic State Of right, and it is right of the personality of the individual, which is essential to the same and has been part of his being since birth.
