Resumo
No Estado Democrático de Direito Constitucional, os Direitos Fundamentais possuem importância diferenciada e a efetivação e ampliação deles constituem uma das principais razões de ser do próprio Estado. Em um país democrático, o Judiciário atua com liberdade e vigora com força a doutrina da separação de Poderes. No entanto, é preciso compreender a forma como se expressa esse Poder e qual o limite de liberdade do magistrado na hora de decidir. Se o Judiciário protege o cidadão que procura obter justiça quando seus direitos são violados arbitrariamente, a decisão judicial também se limita à aplicação do direito e dos princípios constitucionais, sob pena de padecer do mesmo mal. Para compreender essa temática, analisou-se a evolução dos modelos de Estado partindo do absolutista e passando pelas concepções de Estado tipicamente liberal, pelas aspirações socialistas e pelo modelo buscado com a Constituição Federal de 1988. Ao analisar a jurisdição na atualidade, realizou-se importante avaliação das tradições do civil law e do common law. Tratou-se também do alargamento da importância dos precedentes judiciais em todas as áreas do direito, inclusive na Justiça do Trabalho, especialmente em razão da vigência do Código de Processo Civil. Após contextualizar o modelo de Estado e avançar no sentido de que o liberalismo clássico com subsunção do fato à norma não foi suficiente para resolver o problema jurídico, adentrou-se na questão da interpretação do direito, o que se fez pelo estudo das técnicas de hermenêutica clássica e da Teoria da Argumentação Jurídica. Realizou-se levantamento bibliográfico e avaliou-se aspectos históricos, constitucionais, filosóficos e processuais a respeito do tema seguindo a linha crítico-metodológica, em busca de adentrar nas técnicas de interpretação do direito para obter meios de como se agir diante do problema da motivação das decisões judiciais. Conseguir uma decisão corretamente fundamentada é de grande importância, tanto que se analisou e se concluiu pelo enquadramento da motivação como direito de natureza fundamental. Igualmente concluiu-se pela relevância da motivação na efetivação do acesso à justiça. Não basta viabilizar o ajuizamento da demanda judicial, é preciso que o cidadão tenha uma resposta célere, adequada e de acordo com o direito vigente. A decisão judicial motivada é um Direito Fundamental, e a jurisdição tem como dever aplicar as normas jurídicas editadas pelo Estado com vistas à efetivação de princípios constitucionais que representam o modelo de Estado projetado pela Carta Magna vigente.
Abstract
In the state of constitutional law, fundamental rights are important and its effectiveness and expansion is one of the main reasons that justify the State itself. In a democratic country, the Judiciary works with freedom and the separation of powers prevails. However, we need to fully understand how to express this power and what are the limits of freedom when the magistrate decides. If the Judiciary protects citizens that are trying to obtain Justice when their rights are arbitrarily violated, the court decision is also limited by the law and constitutional principles, or else will suffer of the same evil. To understand this issue, we have analyzed the evolution of the state models, from Absolutism to the model pursued by the Federal Constitution of 1988, passing through the typically liberal State Conceptions and the socialist aspirations. To analyze today’s judicial decisions, we cannot forget the civil law and the common law traditions, specially when considering the recent Civil Procedure Code and growing importance of judicial precedents in all areas, including in the Labor Courts. After contextualizing the state model and considering the classical liberalism assumption that the fact should subsumption to the standards, we conclude that this model is not enough, and perhaps never was enough to solve the legal problem. We felt the need to analyze the issue of law’s interpretation, which was made by the study of classical hermeneutic techniques and the legal argument theory. We carried out a bibliographical survey and evaluated historical, constitutional, philosophical and procedural aspects regarding the subject, following the critical methodological line seeking to penetrate the techniques of interpretation of the law to obtain the means of how to act before the problem of motivation of the judicial decisions. It is very important to get a properly reasoned decision, that's why we analyzed the motivation as a fundamental right and its relevance to the issue of the access to Justice. Facilitating the litigation is not enough. It is necessary that the citizens have an adequate state response, in accordance to the existing law. The motivated court decision is a fundamental right. The jurisdiction has a duty to apply the legal rules issued by the State in order to effecting constitutional principles that represent the state model designed by the current Magna Letter.
