Resumo
O trabalho considerou em seu escopo, de maneira sistêmica, o tratamento jurídico oferecido a propriedade intelectual, principalmente no que se releva a licença compulsória como meio de efetivação do Direito fundamental à saúde. Para facilitar o entendimento dos institutos normativos, nos utilizamos de maneira subsidiaria os momentos históricos a nível mundial, demonstrando as principais construções legislativas sobre o assunto, para então discorrermos sobre a importância de se aplicar com parcimônia esse instituto que se apresenta em um primeiro momento de maneira agressiva a propriedade privada, tutelando em seu detrimento o interesse social com principal enfoque a saúde.
Abstract
The work considered in its scope, in a systemic way, the legal treatment offered to intellectual property, especially in what refers to compulsory licensing as a means of enforcing the Law, which establishes health. In order to facilitate the understanding of the normative institutes, we use in a subsidiary way the historical moments in the world, demonstrating the main legislative constructions on the subject, for then we talk about the importance of applying with parsimony this institute that presents itself in a first moment of aggressive way to private property, protecting in its detriment the social interest with the main focus on health.
