Resumo
A presente dissertação tem como escopo a análise crítica do controle de constitucionalidade, como instrumento de ampliação da eficácia dos Direitos Fundamentais difusos e coletivos, sobretudo a partir da teoria do Estado de Coisas Inconstitucional. A proposta da respectiva teoria criada pela Corte Constitucional da Colômbia é de que o controle de constitucionalidade não seja apenas um instrumento pelo qual se busca eliminar do ordenamento jurídico lei ou ato normativo inconstitucional, e com isso salvaguardar os direitos fundamentais indiretamente; mas que se torne um instrumento a buscar efetivamente os direitos fundamentais, podendo impugnar não apenas um lei ou ato normativo inconstitucional, mas também impugnar uma coisa ou um fato inconstitucional, com isso alterando significativamente a realidade generalizada de inconstitucionalidade. Restringe o trabalho à origem, ao conceito, aos pressupostos e à aplicabilidade da Teoria do Estado de Coisas Inconstitucional no Brasil. Além disso também há discussão sobre a legitimidade democrática da Corte Constitucional no exercício do controle de constitucionalidade, bem como da força normativa da Constituição Federal.
Abstract
The present dissertation has scope the critical analysis of the control of constitutionality, as an instrument to broaden the effectiveness of diffuse and collective Fundamental Rights, mainly, demonstrating the theory of the State of Things Unconstitutional. The proposal of the respective theory created by the Constitutional Court of Colombia is that the control of constitutionality is not only an instrument by which it is sought to eliminate from the legal system unconstitutional law or normative act, and with that to safeguard the fundamental rights indirectly, but that becomes an instrument to effectively seek fundamental rights, and may challenge not only a law or an unconstitutional normative act, but also to challenge an unconstitutional fact or fact Restrict the work, origin, concept, assumptions and applicability of the Theory of Things State Unconstitutional in Brazil. In addition, there is also discussion about the democratic legitimacy of the Constitutional Court in the exercise of constitutionality control, as well as the normative force of the Federal Constitution.
