Resumo
O presente trabalho versa sobre a inclusão social da pessoa com deficiência, cuja análise se pauta na nova Lei Brasileira de Inclusão, a Lei nº 13.146, de 06 de julho de 2015, sob o prisma dos direitos fundamentais. Tem como objetivo traçar uma breve leitura sobre a trajetória dos movimentos das pessoas com deficiência até a promulgação da lei que fixa parâmetros para uma sociedade inclusiva, buscando uma reflexão sobre as garantias asseguradas, as mudanças trazidas ao ordenamento jurídico e os primeiros reflexos da sua aplicação. O estudo sobre o Estatuto se fundamenta no eixo constitucional, reforçando as premissas da Convenção sobre os Direitos da Pessoa com Deficiência, ratificada pelo Brasil em 2008 e perpassa por uma discussão interdisciplinar sobre ações afirmativas, políticas públicas e os novos caminhos que se desenham para uma sociedade que oportunize à classe igualdade de condições e autonomia nas decisões.
Abstract
This paper deals with the social inclusion of the disabled person, whose analysis is based on the new Brazilian Inclusion Law, Law no. 13,146, of July 6, 2015, under the prism of fundamental rights. Its objective is to draw a brief reading on the trajectory of the movements of people with disabilities until the enactment of the law that sets parameters for an inclusive society, seeking a reflection on the guarantees guaranteed, the changes brought to the legal order and the first reflections of their application. The study on the Statute is based on the constitutional axis, reinforcing the premises of the Convention on the Rights of Persons with Disabilities, ratified by Brazil in 2008, and is based on an interdisciplinary discussion on affirmative action, public policies and the new paths that are designed for a Society that gives the class equality of conditions and autonomy in decisions.
