Resumo
Discute-se, no presente trabalho, a proteção do direito do autor na sociedade digital ou qual seriam as formas de proteção nessa seara. Com o avanço da tecnologia e a globalização, será que a Lei 9.610/98 vigente é compatível com o atual momento? E o projeto de Lei 3133/2012 acompanha a evolução tecnológica? A Sociedade Digital trata-se de um novo espaço em rede e as informações fluem de maneira veloz devido à internet; um mundo dinâmico, sem fronteiras, onde a liberdade de acesso à informação é fundamental para o desenvolvimento, como diz Ascensão é uma autoestrada da informação. Outrossim, o direito do autor trata-se de um direito intelectual que visa a proteger o criador da obra. Neste sentido, o presente trabalho analisa e conclui que, em se tratando de ambiente virtual, o direito do autor é vulnerável e, portanto, necessária a busca do equilíbrio.
Abstract
We discuss in the present work the protection of the author's right in the digital society or what forms of protection in this area. With the advancement of technology and globalization will the current Law 9.610 / 98 be compatible with the current moment? And does Bill 3133/2012 accompany technological evolution? The Digital
Society is a new network space and information flows fast due to the internet, a dynamic world without borders, where freedom of access to information is fundamental for development, as Ascension says they are information. Furthermore, the author's right is an intellectual right that seeks to protect the creator of the work.
In this sense the present work analyzes and concludes that in the virtual environment, the author's right is vulnerable, the search for balance is necessary.
