Resumo
O principal motivo para a confecção desta pesquisa é, sem dúvida, a
aprovação da Lei nº 13.467/2017, conhecida como Lei da Reforma Trabalhista, e que alterou diversos dispositivos legais contidos na Consolidação das Leis do Trabalho, produzindo em alguns particulares a extinção ou minoração de direitos conquistados ao longo dos tempos pelos trabalhadores. Assim, buscando trazer à alusão os conceitos de direito social, bem como dos princípios gerais do direito e, do principio da vedação ao retrocesso social, procura-se demonstrar os principais aspectos que a Lei reformista retrocedeu com os direitos sociais, sendo, pois, inconstitucional.
Abstract
The main reason for this research is undoubtedly the approval of Law number 13,467 / 2017, known as the Labor Reform Law, and which amended several legal provisions contained in the Consolidation of Labor Laws, producing in some individuals the extinction or reduction of rights earned over time by workers. Thus, seeking to bring to the fore the concepts of social law, as well as the general principles of law, and from the principle of the prohibition against
social retrogression, we try to demonstrate the main aspects that the reformist Law regressed with social rights, unconstitutional.
