Resumo
Este trabalho tem como objetivo aferir, de maneira científica e metodológica, o conflito existente entre o Universalismo e o Comunitarismo na questão dos Direitos Humanos, tendo como base de discussão o caso das mulheres islâmicas na França. A questão principal que leva à presente discussão diz respeito a Lei nº 228, de 15 de março de 2004, também conhecida como "Lei do véu islâmico", que foi considerada uma afronta à cultura islâmica, fazendo com que líderes religiosos do mundo muçulmano manifestassem sua indignação em relação ao governo francês. Assim, no contexto que envolve os Direitos Humanos, serão estudados de forma crítica os filósofos das duas correntes já expostas, ou seja, a universalista e a comunistarista.
Abstract
This work has as objective to study, in the scientific and methodological form, the conflict existent betwen at the Universalism and Comunitarism on the subject of the Human Rights, tends the basic discussion an islamic women's case in French. A principal subject takes that main to present discussion tells respect a Law number 228 (march, 15, 2004), also known how "Law of Islamic Veil", that was considered an insult to the islamic culture, doing religious muslim leaders make a world manifested its indignation in relation to the french government. In that way, on the context that involves the Human Rights, we'll already be studied about a critical way the philosophers of the two currents exposed, or better, an universalist and a comunistarist currents.
