Resumo
A dissertação aborda o tema das gerações de direitos humanos, investigando se elas mantêm ou não identidade com a concepção dialética dos movimentos históricos ocidentais. Para atingir esse objetivo, explicitam-se inicialmente os argumentos utilizados pelas três gerações, para após serem questionados por meio da abordagem histórico-social. A temática é desenvolvida, traçando-se um paralelo entre as gerações de direitos e a mutabilidade social presente em seus momentos históricos, no intuito de averiguar se há correspondência entre ambas. É analisada a essência da teorização, qual seja, a concepção dos direitos humanos veiculada por sua divisão estanque, a saber: os de liberdade, os de igualdade e finalmente os de solidariedade. A noção de gerações não compreende, portanto, os direitos humanos como produto de construção dialética, histórica e social, pois possibilita uma equivocada acepção imutável dos mesmos.
Abstract
This paper refers to the generations of human rights, intending to examine whether they keep identity with the dialectic conception of the western historical movements or not. ln order to reach this aim, the arguments used by the three generations will be emphasiezd, and then, these arguments are questioned making use of a historical social approach. The theme is developed regarding the generation of rights and the social changes observed in its historical movements, in an attempting to investigate the possibility of a relationship between them. The essence theory feature is also analyzed, that is, the conception of human rights in relation to its unchangeable division represented by the liberty right, the equally right and finally the solidarity one. In conclusion, the generation notion does not regard the human rights as a dialectic, historical and social construction product for enabling the possibility of a mistaken unchangeable idea of the human rights.
