Resumo
O objetivo desta pesquisa foi investigar as semelhanças e diferenças entre a Lei n° 5.692/71 e a LDB n° 9.394/96 atualmente em vigor, com a intenção de analisar o que essa primeira lei introduziu e ainda mantém na composição da segunda. Realizamos essa pesquisa por intermédio dos procedimentos metodológicos de levantamento e análise de documentos e consulta bibliográfica sobre o tema em estudo. A elaboração da pesquisa e a composição deste texto procuram atender aos requisitos do método comparativo realizado por Aguilar (2000. Com Lei n° 5.692/71 a intenção governamental explícita era atualizar a educação e "tirar o país do atraso" e na LDB n° 9.394/96 a intenção dos educadores era estabelecer novas diretrizes para a educação nacional. Em 1970 o Poder Executivo editam o Decreto n° 66.600/70 nomeando um Grumo de Trabalho para elaborar um anteprojeto de Lei reformando o ensino primário e médio. Em 1988, a iniciativa de propor uma nova LDB partiu do Poder Legislativo. A Lei nº. 5.692/71 surgiu durante a ditadura militar, enquanto que o movimento para a elaboração de uma nova LDB surgiu durante a época de redemocratização do país. No período de elaboração da Lei nº. 5.692/71, a sociedade encontrava-se desmobilizada devido ao regime político vigente. No período de elaboração da nova LDB a sociedade já se encontrava mobilizada devido ao retorno da democracia. O processo de tramitação da Lei nº. 5.692/71 foi muito breve, havendo pouca negociação no Congresso Nacional, enquanto que o processo de tramitação da nova LDB foi longo, havendo muitas negociações, tanto na Câmara quanto no Senado. Finalizado o processo de tramitação da Lei nº. 5.692/71 podemos concluir que ela atendeu aos objetivos do governo militar, enquanto que, ao final do processo de tramitação da nova LDB, podemos observar que houve uma política de conciliação, prevalecendo ao final as propostas do Poder Executivo. Isso porque a maioria dos artigos inseridos na LDB nº. 9.394/96 provieram do projeto apresentado pelo Senado Federal, e não daquele, oriundo da Câmara dos Deputados.
Abstract
The purpose of this study was to investigate the similarities and differences between the Laws n° 5.692/71 and n° 9.394/96/ LDB currently in use, with the intention to analyze what the first law introduced and how it altered the composition of second. The methods used to accomplish this research were analysis of legal documentation, support material, and bibliographical consultation of the subject. This study was written and elaborated accordingly with the comparative method carried through by Aguilar (2000, p. 15). In resume we can establish the following comparisons. In the Law n° 5.692/71 government intention was to update the education system and "to take off the country of its holdup" and in the law n° 9,394/96 LDB the educators’ intention was to establish new benchmarks for the national education. In 1970 the Executive branch of the Federal Government edits the Decree n° 66.600/70 nominating a GT to elaborate a proposal to remodel elementary and high school. In 1988, another proposal for a new LDB law was initiated by the Legislative branch of the Federal Government. The Law nº 5.692/71 was established during the military dictatorship, meanwhile a movement for elaboration of a new LDB started to take place during the democratization movement time. During the elaboration of the Law nº 5.692/71, social movements had disappeared due to the politics in practice at that time. In the period of elaboration of the new LDB, society was mobilized due to the return of the democracy. The negotiation process for the Law nº 5.692/71 was very brief, having little negotiation in the National Congress, on the other hand the negotiation process for the new LDB was very long, many discussions took place on both houses, House of Representatives and Senate. When the negotiation process of Law nº 5.692/71 ended, the conclusion was that this law followed the objectives of the military government. By the end of the negotiation process for the new LDB, we can easily observe that a conciliation police took place mixing and matching the project originated on the House of Representatives with the one derived from the Executive branch and in the end the Executive proposals prevailed. This because the majority of inserted articles in the LDB nº. 9.394/96 had come from the project presented for the Federal Senate, and not from the PLC nº. 1.258/88, deriving of the House of Representatives.
