Resumo
Este estudo tem a finalidade de analisar, mais profundamente, a realidade de alguns movimentos populares no Brasil. Como problemática central tem-se a seguinte questão: os movimentos populares representam a principal fonte das transformações sociais ocorridas no âmbito jurídico podendo, os mesmos, legitimarem seus atos, por meio do instituto do direito de resistência e da desobediência civil? Estas reivindicações são eficazes na legitimação de direitos fundamentais já existentes da pessoa humana e que ainda não foram efetivados? Dentro desta conjuntura são utilizados os ensinamentos da Teoria Crítica do Direito para esta análise. A grande importância do tema se faz necessário quando, dentro de um Estado Democrático de Direito, coloca-se em questão à forma de representatividade política em vigor, a qual já não mais representa os anseios sociais, distanciando-se de sua essência, buscando, dentro de uma visão crítica, entender que o Estado hoje, tem como uma de suas principais funções manter a paz e harmonia social, não gerando riscos e instabilidades ao setor econômico, ao qual tem como seu principal aliado à minoria capitalista detentora da maior parte financeira da economia. Dentro deste jogo de interesses, o povo é utilizado como peça na manutenção do conservadorismo social. No limite extremo do insuportável e do descaso estatal, emergem das camadas mais excluídas os movimentos populares que buscam romper com o sistema vigente, almejando a gênese da formação do Estado. Suas reivindicações vêm em primeiro lugar; seus movimentos passam a desobedecer ou resistir a atos ilegais ou normas injustas que atentam contra seus interesses, isto depois de esgotados todos os meios jurídicos legais, na busca de um novo horizonte sem alienações e dominações, na procura da verdadeira essência da existência de todo ser humano, a felicidade.
Abstract
This study aims to examine more deeply the reality of some popular movements in Brazil. As central problem we have the following question: Do the popular movements represent the main source of social transformations occurring under legal jurisdictions, but in the same, legitimize their actions through the institution of the law of resistance and civil disobedience? Are these claims effective in legitimizing the existing rights of the human person, that haven´t been carried out yet? Within this situation, we will make use of the teachings of the Critical Theory of the Law for this analysis. The greatest importance of the subject becomes necessary when, within a Democratic State of Law, it is put in debate the current form of Political Representativeness, which no longer represents the social longings, distancing itself from its essence, searching, within a critical vision, to understand that the State nowadays has, as one of its main functions, to maintain the peace and social harmony, not producing risks and instability to the economical sector, which has as its main ally the capitalist minority holder of most financial share of economy. Within this set of interests, people are used as a piece in the maintenance of the social conservatism. On the high end of the unbearable and the disregard from the State to the people, emerge from the most excluded social layers popular movements that seek to break up with the current system, aiming the genesis of the formation of the State. Their claims come first; their movements now start to resist or disobey the unfair rules or illegal acts that go against their interests, this after the exhaustion of all legal means, in the search for a new horizon without divestments and dominations, in search of the true essence of the existence of all human beings, the happiness.
