Resumo
O presente trabalho objetiva analisar a configuração jurídica da liberdade educacional às instituições privadas de educação superior no Brasil, a partir da promulgação da vigente Constituição Federal (1988), até 2002, quando terminou o mandato do Presidente Fernando Henrique Cardoso. Sob a perspectiva dessa modalidade de estabelecimento educacional, o mencionado instituto jurídico será estudado em dois de seus prismas: a livre iniciativa e a liberdade acadêmica. Tal análise será efetivada observando-se as similaridades de sua configuração com as concepções expostas em documentos de política elaborados, no período, pelo Banco Mundial, identificadas como paradigma do neoliberalismo educacional.
Abstract
It is intended, with this study, to analyse the legal configuration of educational freedom at private institutions of higher education in Brazil, from the promulgation of the current Constitution (1988), to 2002, when the mandate of President Fernando Henrique Cardoso ended. From the perspective of this type of educational institution, the mentioned legal institute will be studied in two of his prisms: the academic freedom and free enterprise. This analysis will be done paying attention in the similarities of their configuration and the ideas outlined in the World Bank's policy documents, prepared during this period, identified as paradigm of educational neo-liberalism.
