Resumo
O Direito Civil sofre um grande processo de transformação. A entrada em vigor do Código Civil de 2002 acentuou essas mudanças, principalmente no que diz respeito ao Direito de Família. Além de outros fatores, a modernização da sociedade, a velocidade das informações bem como as novas descobertas científicas influenciam diretamente as relações sociais e, conseqüentemente, o Direito Civil. A proposta do presente estudo é abordar algumas questões que surgem com as inovações trazidas no bojo do artigo 1.597 do Novo Código Civil, dando uma atenção especial às relações oriundas da previsão existente no inciso V. Tendo como objetivo maior a análise da responsabilidade civil, decorrente da doação de material genético nos casos de inseminação artificial heteróloga, este estudo aborda ainda as possíveis variações decorrentes desta responsabilidade para os casos nos quais há ou não o consentimento de um dos cônjuges ou dos conviventes para a realização dos procedimentos. .
Abstract
Civil Law has suffered great renovation. The 2002 Civil Code stressed these transformations mainly in what concerns the Family Law field. The modernization of the societies and the speed of information, along with recent scientific discoveries have directly influenced the Civil Law. This paper aims to discuss the innovations found in the roots of the article 1.597 of the New Civil Code, giving special attention to the relations originated in the incise V. We intent to analyze the civil responsibility as the result of a genetic material donation in cases of heterologous artificial insemination; this paper also deals with possible variations of this responsibility in cases where it may or not occur assentiveness from one of the spouse or companion for the procedure accomplishment.
