Resumo
A presente dissertação intenta realizar uma abordagem sobre o pensamento de Roberto Lyra Filho. Sabe-se que o ponto de vista crítico do jurista, falecido em 1986, cultivou uma originalidade reconhecida mesmo internacionalmente. Ele cuidou por trazer para o ambiente jurídico, aportes teórico-filosóficos novos. Quando pergunta sobre o que é o Direito, ele quer propor uma nova ontologia que encontra a essência do Direito longe da norma imutável e fixa. Da releitura hegeliano/marxista, Lyra Filho colhe as bases para o humanismo dialético, que afirma a possibilidade de um pluralismo jurídico. Estes são pontos presentes no trabalho e que resultam na revalorização do Direito, para além do Direito estatal expresso na lei. Por rejeitar o jusnaturalismo e o positivismo jurídico como soluções acabadas para o Direito, Roberto Lyra Filho oferece um outro caminho para revitalizar o Direito. Assim é que, torna-se fundamental compreender que o Direito se dá na história. Compreender a história de forma dialética significa observar as relações humanas repletas de conflitos. As conseqüências dessa abordagem para o Direito Penal conduzem a uma reflexão também crítica sobre a criminologia e o Sistema Penal. Reconhece na crise de paradigma daquela área sua face ideológica. Por meio da análise da realidade criminal, identifica determinada tendência em se criminalizar condutas, de determinada classe social. O Direito se torna meio de controle social a favor da classe hegemônica. Lyra Filho procura enxergar, então, a legitimidade de uma ordenação jurídica diferente da produzida pelo Estado. E encontra nas lutas sociais a efetivação dos Direitos Humanos.
Abstract
The objective of the present dissertation is to approach the thoughts of Roberto Lyra Filho. It is known that the critical point of view of the jurist, deceased in 1986, cultivated an originality recognized even internationally. He was responsible for bringing new theoretical-philosophical contributions to the juridical environment. When asking what Law is, he wants to offer a new ontology that finds the essence of Law far from a firm and immutable norm. From a Hegelian-marxist rereading, Lyra Filho obtains the bases for dialectical humanism that asserts the possibility of a juridical pluralism. These are arguments present in his work, resulting in the revalorization of Law, over and above state Law expressed in norms. By rejecting jusnaturalism and juridical positivism as complete solutions for Law, Roberto Lyra Filho offers another way to revitalize Law. In that way it is fundamental to understand Law in History. Understand history in a dialectical way means to observe human relationships replete of conflicts. The consequences of this approach for Criminal Law lead to an equally critical reflection on criminology and the Penal System, i.e., to recognize in the paradigm crisis of this area its ideological aspect, and through the analysis of criminal reality, identify the tendency of criminalizing conducts of a certain social class. Law becomes a way of social control in favor of the hegemonic class. Lyra Filho tries to discover, therefore, the legitimacy of a juridical arrangement different from that produced by the State, finding in social struggles the enactment of Human Rights and the achievement of Law.
