Resumo
O presente trabalho, sem a pretensão de esgotar o tema, compreende um estudo sobre o regime da comunhão parcial de bens na união estável, entre um homem e uma mulher, analisando os direitos patrimoniais. Com o advento da Constituição Federal de 1.988 a união estável foi elevada à condição de entidade familiar, posteriormente amparada pelo regime jurídico familiar e patrimonial das Leis 8.971/94 e 9.278/96 e, disciplinada pelo Código Civil de 2002. Na união estável aplica-se o regime da comunhão parcial de bens às relações patrimoniais, salvo contrato escrito entre os companheiros, abordando-se neste trabalho, a aplicação ou não de certas peculiaridades ao homem e a mulher que vive em união estável, concedidas aos cônjuges no casamento, como a administração dos bens comuns, a concessão da fiança e do aval, a outorga para venda de bens comuns, a doação entre si e a sucessão.
Abstract
This study accosts the system of partial community property system to the stable union, between a man and a woman, specially the property rights. Due the arrival of the Federal Constitution, in 1988, the stable union is considered a family entity, whose specific rules, that includes the property rights, are predicted in Laws 8.971/94 and 9.278/96, and, nowadays, the Civil Code, 2002. To the stable union, it is applied the partial community property system, unless there is a different convention about it, that must be written in a contract, which provokes certain singular situations to the couple living that way, that also will be studied, as well as the administration of the couple’s state, bail and collateral signature, consent or authorization of the spouse, the donation and sucession.
