Resumo
Genericamente, o presente trabalho se propõe a resgatar o estudo sobre um pensador nacional de grande importância para a Filosofia do Direito no Brasil, pouco pesquisado, muito incompreendido e quiçá mal interpretado, como resposta ao colonialismo cultural jurídico que assola a Academia Jurídica Brasileira, não só nos tempos atuais, como também em seus primórdios. Especificamente, o trabalho tem por objetivo demonstrar que além dos aspectos do fenômeno jurídico explicitamente analisados por Pontes de Miranda no tomo III de sua obra Sistema de Ciência Positiva do Direito (mecânico, biológico, sociológico, ideológico e técnico), outros aspectos também por ele foram abordados de forma implícita nos tomos I, II e IV da referida obra (psicológico, político e gnosiológico), os quais são reputados igualmente importantes para a compreensão do fenômeno jurídico, ou seja, para o estudo científico do Direito. Finalizando, procuramos identificar a corrente metodológica adotada, seguida e influenciadora de Pontes de Miranda.
Abstract
Generically, the present work if considers to rescue the study on a national thinker of great importance for the Law Philosophy in Brazil, little searched, very misunderstood and perhaps badly interpreted, as reply to the legal cultural colonialism that devastates the Brazilian Legal Academy, not only in the current times, as well as in its origin. Specifically, the work has for objective to demonstrate that beyond the aspects of the legal phenomenon explicit analyzed by Pontes de Miranda in tome III of its workmanship System of Positive Science of the Right (mechanic, biological, sociological, ideological and technician), other aspects for it had also been boarded of implicit form in tome I, II and IV of the related work (psychological, politician and gnosiological), which we repute equally important for the understanding of the legal phenomenon, that is, for the scientific study of the Right. Finishing, we look for to identify the methodological chain adopted, followed and influential of Pontes de Miranda.
