Resumo
O presente estudo examina o fenômeno da liberdade religiosa e sua relação com a construção da cidadania. Parte da premissa de que o ser humano ao longo da história tomou a felicidade como um conceito ideal absoluto que busca alcançar através da concretização do conceito instrumental absoluto de dignidade humana. Esse último se materializa através dos conceitos instrumentais relativos estampados nos direitos humanos fundamentais. Demonstra que o Estado brasileiro procura se acomodar a essa dinâmica através da valoração, em seu texto constitucional, do ambiente democrático, o qual pressupõe o pleno exercício da cidadania através da efetivação das liberdades em grau máximo a todos os seres humanos. Assim é que a máxima efetividade da liberdade religiosa nas suas vertentes da liberdade de associação, liberdade de culto, liberdade de consciência e liberdade de crença, torna-se pressuposto da garantia, não só da dignidade humana, mas também do pleno exercício da democracia e da construção da cidadania, essas últimas conceituadas de forma ampla e irrestrita. Considera ao final que sem a plena efetividade da liberdade religiosa o ser humano é menos ser e menos humano, assim como a democracia é menos democracia e o cidadão é menos cidadão.
Abstract
This paper looks into the phenomenon of religious freedom and its relationship with the building up of citizenship. It starts from the premise that the human being has taken the concept of happiness to be the ultimate ideal he/she strives to attain along history through the materialization of the absolute instrumental concept of human dignity. And this is materialized through such relative instrumental concepts as are set down in the basic human rights. It further demonstrates that the Brazilian nation as set forth in its constitution seeks to adapt to this dynamic through the valuation of the democratic environment which presupposes the full exercise of citizenship by means of extending freedom in its highest degree to all human beings. Thus, the granting of religious freedom in its highest degree under such aspects as freedom of association, freedom of cult, freedom of conscience and freedom of creed, becomes the presupposition of guarantee not only of human dignity but also of the full exercise of democracy and citizenship, the latter thought of as far reading and unrestricted. The paper reaches the conclusion that without the full exercise of religious freedom, the human being in rendered less being and less human in the same measure as democracy becomes less democracy and the citizen less citizen.
