Resumo
O presente trabalho discorre sobre a interrupção da gestação nos casos de anencefalia sob a óptica dos Direitos Humanos Fundamentais. Propõe a analisar tanto a crise enfrentada pelo sistema judiciário brasileiro, quanto à enfrentada pelas mães com relação à efetividade do direito de decisão a continuidade ou não da gestação, destacando-se não só a vida, mas também a dignidade humana, como bens jurídicos primordiais resguardados pela Constituição Federal. Diante dos questionamentos levantados acerca dos diferentes posicionamentos jurídicos e, com base na legislação vigente, demonstramos que o conflito entre Direitos Fundamentais deve ser analisado de acordo com a precedência entre os direitos envolvidos, no caso concreto, da genitora que prevalecem em detrimento dos direitos do feto anencéfalo.
Abstract
This paper reports about the termination of a gestation in cases of anencefaly from the standpoint of the Basic Human Rights. Its purpose is to analyze both the crises of Brazilian legal system, and also the crises faced by mothers in relation to the effectivity of the right to make the decision regarding the termination of pregnancy or not, highlighting not only life, but also human dignity such as primary legal rights provided by the Federal Constitution. Due to questions aroused regarding the different standings of the law, and based on the current legislation, the conflict interpreting Basic Rights must be analyzed in lights of precedence among the people involved, in this case, the female genitor, wich prevails in the detriment of the rights of the ancencefalic fetus.
