Resumo
Kant, há mais de duzentos anos, apresentou no opúsculo À Paz Perpétua, um projeto filosófico para a efetivação da paz mundial. A filosofia jurídico-política kantiana, no tocante à paz perpétua, está fundamentada em três ideias básicas: a constituição republicana, a federação de Estados e o direito cosmopolita. No contexto da obra kantiana, a filosofia jurídico-política e a paz como ideia reguladora fazem parte da arquitetônica da razão prática e têm sustentação definitiva na razão pura legisladora. Para Kant, a constituição republicana é a única derivada do conceito de direito e capaz de garantir a liberdade e a paz; a federação dos Estados concebe um ordenamento internacional que assegura a soberania dos Estados e garante o direito de permanecer em paz como regra universal; e por fim, o direito cosmopolita fornece os elementos teóricos e práticos necessários para a formação de uma comunidade jurídica universal, bem como para a elaboração de uma constituição cosmopolita. O fio condutor subjacente ao projeto kantiano da paz perpétua concentra-se na ideia de progresso para o melhor, presente na História da humanidade, bem como na ação da natureza em prol da realização do sumo bem político. Esta dissertação pretende apresentar a paz kantiana, como uma nova ordem jurídica internacional, identificando sinais concretos de sua efetivação na atualidade.
Abstract
Kant, for over two hundred years, presented in the booklet Perpetual Peace, a philosophical project for the realization of world peace. The legal-political philosophy with regard to Kantian perpetual peace, is based on three basic ideas: the republican constitution, the federation of states and cosmopolitan law. In the context of Kant's work, the legal-political philosophy and peace as a regulative idea of architectural part of practical reason and has definite support in pure reason legislator. For Kant, the republican constitution is the only derived from the concept of law and capable of freedom and peace, the federation of the international order, on e sees that ensures the sovereignty and guarantees the right to live in peace and universal rules, and Finally, the cosmopolitan law provides the theoretical and practical elements necessary for the formation of a universal legal community, as well as for the development of a cosmopolitan constitution. The guiding principle behind the Kantian project of perpetual peace focuses on the idea of progress for the best gift in the history of mankind and of nature in action in favor of achieving the ultimate good politician. This paper intends to present the Kantian peace, as a new international legal order, identifying concrete signs of its coming into effect today.
