Resumo
O presente trabalho busca analisar a regulamentação da abertura do mercado ressegurador brasileiro e a participação da sociedade civil internacional nesse processo de regulamentação, por meio dos métodos indutivo, histórico, hermenêutico e comparativo. Em virtude da elevada extensão do assunto, adotou-se, como delimitação temática, a análise geral da Lei Complementar n. 126 de 2007, responsável pela quebra do monopólio de setenta anos no mercado ressecuritário nacional, e de suas principais disposições bem como das motivações dos vetos do Poder Executivo; seguida de uma análise pormenorizada da minuta que deu origem à Resolução do Conselho Nacional de Seguros Privados - CNSP n. 168 de 2007, das suas principais propostas de alteração apresentadas na audiência pública pela sociedade civil e das respectivas justificativas que levaram à redação final da Resolução CNSP n. 168 de 2007.
Abstract
This study aims to analyze the regulation of the opening of the Brazilian reinsurance market and the participation of international civil society in this process of regulating, through indutive, historical, hermeneutic and comparative methods. Due to the high extent of the subject, was adopted as the delimitation issue, the general analysis of the Complementary Law n.126, 2007, responsible for breaking the monopoly of seventy years in the national reinsurance market, and its main provisions and the motivations of the vetoes of the Executive, followed by a detailed analysis of the draft that led to the Resolution of the National Council of Private Insurance - CNSP n. 168, 2007, its main amendments proposed at the hearing by the civil society and their justifications that led to the final draft of Resolution No CNSP 168, 2007.
