Resumo
O desejo no aprofundamento de uma pesquisa sobre o tema “poluição sonora” foi motivado de modo direto pela observação quanto ao bem-estar que se sente pelo som agradável, e o incômodo causado por sons indesejáveis, quando se trata de estabelecer um grau de sensibilização, nos problemas ambientais próximos, relacionados diretamente com a Cidadania, o conhecimento do Direito e da Educação ambiental. Avaliou-se juridicamente a possibilidade de responsabilização dos envolvidos pela emissão de ruídos fora dos parâmetros legais, nas esferas administrativa, penal e civil, tanto no que se refere à pessoa física quanto à pessoa jurídica. Nesse sentido, todo o trabalho foi direcionado na procura de se estabelecer conhecimentos epistemológicos na doutrina, na jurisprudência e na legislação existentes para mostrar toda a problemática que envolve o tema, de uma forma geral, e o assunto objeto de estudo, de maneira mais específica, sempre com intuito de mostrar quais são os problemas gerados pela poluição sonora, como combatê-la e o porquê o Estado tem dificuldades para resolver os problemas a ela relacionados. Surgiu com isto, a necessidade de se definir o que vem a ser meio ambiente, direito ambiental, poluição sonora, bem como identificar os instrumentos de prevenção, controle e repressão deste tipo de poluição, para, finalmente, expor como deve ser exercido o poder de polícia ambiental. Enfim, estão demonstrados que estes instrumentos, se devidamente utilizados, mitiga os problemas relacionados à poluição sonora.
Abstract
The desire for further research on noise pollution was driven strictly by observing the well-being sense that is felt by the pleasant sound and the nuisance it causes undesirable sounds. This is to establish an awareness sense over the environmental problems directly related to citizenship, the knowledge of environmental education and the right. It was legally evaluated the possibility of the responsibility and accountability of those involved on the propagation of noise outside the legal parameters, in the administrative, criminal and civil matters, both as regards the individual as the legal entity. In this sense, all work was directed at seeking on how to establish epistemological knowledge on the doctrine, jurisprudence and the legislation existents in order to show in a general way, all the problems surrounding this issue, as well as the subject studied, more specifically, always with the goal of recording what are the problems caused by the sound pollution (noise), how to fight it, and why the State has difficulty restraining it. It came up, therefore, the need to define what has to be the environment, environmental law, noise pollution, what are the sources of noise pollution, as well as how to identify the instruments of prevention, control and repression of such pollution, to finally, exposes how the power of the environmental police must be accomplished, meaning, by public officials qualified technical and legally to exercise its functions effectively. Finally, it.s demonstrated that these instruments, if properly used will prevent the problems related to noise pollution.
