Resumo
A poluição eletromagnética advinda das estações de rádio base da telefonia celular, embora seja um assunto novo e pouco tratado, certamente tem uma influência direta no meio ambiente, afetando não só a saúde dos seres vivos que habitam o planeta mas também a sua economia. Dessa forma, o assunto necessita de uma discussão jurídica, especificamente da área do Direito Ambiental. No presente trabalho analisam-se juridicamente as normas que disciplinam as emissões advindas das estações de rádio base, o setor das telecomunicações, a
relação de consumo entre o usuário da telefonia móvel celular e as empresas que exploram essa atividade, além do direito de não receber as emissões advindas dessas estações, propondo-se uma reflexão quanto à segurança jurídica que essas normas apresentam.
Abstract
The Environnmental Tutorage concerning the Eletromagnetic Pollution from
the Mobile Personnal Cellular Telephony Radio Base Stations The electromagnetic pollution from cellular phones radio base stations,
although being a new and unexplored subject, certainly has a direct influence in the environment, affecting negatively not only living organisms but also the economy.Therefore, the matter demands legal discussion, especially in the Environmental Law. In this work we examine juridically the norms which discipline the emissions
from the radio base stations, the telecommunications enterprises, the consumer relationship between the user of the mobile cellular telephony and the telephony enterprises, and also the right of refusing the radio base emissions, proposing a reflection about the legal security offered by these norms.
