Resumo
Este trabalho versa sobre os conflitos coletivos do trabalho e a tutela dos direitos sociais na República Federativa do Brasil. Inicialmente, percorre as questões relacionadas com os direitos fundamentais do homem, apresentando uma breve evolução histórico-social desses direitos, com o enfoque centrado no surgimento dos direitos fundamentais sociais e dos Estados constitucionais. Considerando os
eventos sociais ocorridos durante o século XX e as transformações sociais decorrentes, discute-se uma nova visão do Estado moderno, apresentando os principais aspectos do chamado neoconstitucionalismo, sua influência na aplicação do Direito na sociedade, como a questão que envolve a aplicação de princípios e regras, a valorização dos direitos fundamentais do homem e a promoção da dignidade humana, apresentando e caracterizando, nesse contexto, os direitos sociais existentes na Constituição. Tendo esse contexto definido e delineado, trata da questão dos conflitos coletivos do trabalho e suas características, expondo as diversas formas de composição existentes, bem como o papel que os seres coletivos possuem no ordenamento após a Constituição de 1988, discutindo suas características e limitações.
Abstract
This paper describes the collective labor conflicts and the protection of social rights in the Federative Republic of Brazil. Initially, it covers issues related to the fundamental rights of man, with a brief historical and social evolution of these rights, with attention focused on the emergence of fundamental social and constitutional states. Considering the social events that occurred during the twentieth century and the social changes, we discuss a new vision of the modern state, presenting the main aspects of neoconstitutionalism called, its impact on the application of law in society, as the question involves the application of principles and rules, the enhancement of fundamental human rights and promoting human dignity, presenting and characterizing this context, the existing social rights in the Constitution. Having
defined and outlined this context, addresses the issue of collective labor conflicts and their characteristics, explaining the various existing forms of composition, as well as the role that collective beings possess in order after the 1988 Constitution, discussing
their characteristics and limitations.
