AÇÕES AFIRMATIVAS E LIMITES ÀS POLÍTICAS PÚBLICAS DE IGUALDADE.

Resumo
O presente trabalho aborda o tema das políticas públicas afirmativas, desde a sua fundamentação sociológico-jurídica até o tratamento da doutrina e jurisprudência pátria. Enfatiza-se a singularidade desta espécie de política pública no ordenamento jurídico brasileiro. Esclarecemos que uma das principais preocupações da dissertação se volta a transmitir as ideias primordiais e as pesquisas a respeito do instituto de forma a facilitar o entendimento do leitor. A prioridade no desenvolvimento do trabalho é tornar a leitura mais agradável e compreensível na medida da possibilidade de trazer os principais pontos do tema e seus reflexos. Desenvolveu-se o mérito em três fases, priorizando a assimilação do tema, como acima mencionado: as ações afirmativas, as políticas públicas, e as decisões governamentais e suas limitações. Aborda-se, por questões didáticas, as ações afirmativas em três divisões: o precedente axiológico, qual seja: o princípio da igualdade; o precedente histórico-comparado, desde a formação do instituto até sua apresentação no direito comparado; e, finalmente, o instituto quanto a sua natureza e sua experiência brasileira. A igualdade, precedente axiológico das ações afirmativas, é trazida a partir da idéia histórica e contemporânea do valor agregado.Os precedentes histórico-comparados das ações afirmativas vinculam o instituto ao seu surgimento e desenvolvimento na história de alguns países, especialmente nos E.U.A. (local de grande desenvolvimento do tema). Fixadas as premissas axiológicas e normativas, passaremos a cuidar da natureza do instituto e de seu conceito, onde focaremos os objetivos buscados pelas ações afirmativas, já nos preparando para vincularmos o assunto as políticas públicas. Relembramos que a preocupação do trabalho se volta a um fácil estudo do assunto, daí porque a necessidade de se trabalhar um conceito do tema que englobe as diversas ideias em voga. Após, teceremos considerações sobre políticas públicas, tema que ora dividimos em duas linhas de pesquisa: o que seriam as chamadas políticas públicas e os mecanismos voltados a implementação destes atos, seja na esfera administrativa, seja na seara legislativa.
Abstract
This paper addresses the issue of public policy statements, from its foundation to the sociological and legal treatment of the doctrine and jurisprudence homelands. We emphasize the uniqueness of this kind of public policy in the Brazilian legal system. Clarify that a major concern of the thesis turns to transmit the prevailing ideas and research about the institute in order to facilitate the reader's understanding. The priority in developing the work is to make reading more enjoyable and understandable as the possibility of bringing the main points of the topic and your reflexes. Developed the merits in three phases, prioritizing the assimilation of the topic, as mentioned above: affirmative action, public policy and government decisions and their limitations. Addresses, for didactic reasons, affirmative action in three divisions: the precedent set of values, namely: the principle of equality, compared to historical precedent, since the formation of the institute until his presentation on comparative law, and finally the Institute as its nature and its Brazilian experience. Equality, the previous set of values of affirmative action, is brought from the idea of the historical and contemporary value. The foregoing historical comparison of the institute affirmative action link its emergence and development in the history of some countries, especially in the U.S. (a place of great development of the subject). Fixed axiological and normative assumptions, we will take care of the nature of the institute and its concept, which will focus on the objectives sought by affirmative action, already are preparing to link the issue to public policy. Please note that the concern of the work turns to an easy study of the subject, which is why the need to work a concept of theme that embraces the diverse ideas in vogue. After, we offer public policy considerations, a topic that sometimes divide into two lines of research: what would be called public policy and mechanisms aimed at implementation of these acts, whether at the administrative level, either in the legislative harvest.
